OVERVIEW

These Terms of Service (“Terms”) govern your access to and use of the Maddy Makers website and storefront (“Store”), including all related information, content, features, products, services, and tools offered through the Store.

The Store is powered by Shopify, which enables us to operate the Store, process orders, and provide e-commerce functionality.

By visiting, browsing, purchasing from, or otherwise using the Store, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, please discontinue use of the Store immediately.

SECTION 1 — ELIGIBILITY & ACCOUNT RESPONSIBILITIES

By using the Store, you confirm that:

  1. you are at least the age of majority in your jurisdiction, or
  2. you are using the Store under the supervision of a parent or legal guardian.

You agree to provide accurate, current, and complete information when creating an account or placing an order.

You are responsible for:

  3. all activity conducted under your account.

We reserve the right to suspend or terminate accounts containing false, misleading, or incomplete information.

SECTION 2 — PRODUCTS & SERVICES

Many products sold through the Store are made-to-order and fulfilled through third-party print-on-demand and fulfillment partners.

We make reasonable efforts to display:

  1. product colors,
  2. images,
  3. sizes,
  4. descriptions,
  5. specifications

as accurately as possible. However:

  1. colors may vary depending on screen settings,
  2. print placement may slightly vary,
  3. sizing may differ slightly due to manufacturing tolerances.

We do not guarantee that products will exactly match on-screen representations.

Product availability, pricing, descriptions, and specifications may change without notice.

SECTION 3 — ORDER ACCEPTANCE

Placing an order constitutes an offer to purchase products from the Store.

Orders are not considered accepted until:

  1. payment has been authorized,
  2. payment has been processed successfully,
  3. order confirmation has been issued.

We reserve the right to:

  1. refuse or cancel orders,
  2. limit quantities,
  3. reject suspicious or fraudulent transactions,
  4. restrict orders at our sole discretion.

SECTION 4 — ORDER CANCELLATIONS & MODIFICATIONS

Orders may only be canceled or modified within 4 hours of placement.

After this period, orders may already be:

  1. in production,
  2. packed,
  3. or shipped,

and cannot be canceled or changed.

All cancellations, returns, refunds, and replacements are governed by our Refund & Return Policy.

SECTION 5 — PRICING & BILLING

All prices displayed on the Store are subject to change without notice.

Unless otherwise stated:

  1. prices do not include taxes,
  2. shipping fees,
  3. customs duties,
  4. import charges,
  5. or other government fees.

You agree to provide accurate billing information and authorize us to charge your payment method for all purchases and related costs.

We reserve the right to correct:

  1. pricing errors,
  2. product information errors,
  3. typographical mistakes

even after an order has been submitted.

SECTION 6 — SHIPPING & DELIVERY

Delivery times provided on the Store are estimates only and are not guaranteed.

Because we work with third-party fulfillment providers and global shipping carriers, delays may occur due to:

  1. courier disruptions,
  2. customs inspections,
  3. production delays,
  4. weather conditions,
  5. high seasonal demand,
  6. international logistics issues,
  7. events beyond our reasonable control.

Once an order is transferred to the shipping carrier, risk of loss passes to the customer.

Customers are responsible for providing accurate shipping information.
Additional shipping charges may apply for incorrect or incomplete addresses.

SECTION 7 — INTERNATIONAL ORDERS

International orders may be subject to:

  1. customs duties,
  2. import taxes,
  3. VAT,
  4. brokerage fees,
  5. additional local charges.

These charges are determined by the destination country and are the customer’s responsibility unless otherwise stated.

We are not responsible for customs delays or additional import charges.

All Store content, including:

  2. graphics,
  3. product designs,
  4. images,
  5. text,
  6. branding,
  7. website content

is owned by Maddy Makers, Shopify, or applicable licensors and is protected by intellectual property laws.

You may not:

  1. reproduce,
  2. distribute,
  3. modify,
  4. resell,
  5. copy,
  6. exploit

any Store content without prior written permission.

SECTION 9 — USER CONTENT & FEEDBACK

If you submit:

  1. reviews,
  2. comments,
  3. suggestions,
  4. ideas,
  5. feedback,
  6. photos,
  7. social media tags

you grant Maddy Makers a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, publish, and display such content for promotional or operational purposes.

You confirm that:

  1. you own the rights to submitted content,
  2. your content does not violate any law or third-party rights.

We reserve the right to remove content deemed inappropriate or unlawful.

SECTION 10 — PROHIBITED USES

You may not use the Store:

  1. for unlawful purposes,
  2. to violate laws or regulations,
  3. to infringe intellectual property rights,
  4. to harass, abuse, or harm others,
  5. to upload malicious code,
  6. to scrape or collect data,
  7. to interfere with Store operations,
  8. to bypass security measures,
  9. for fraudulent or deceptive activities.

Violation of these Terms may result in immediate termination of access.

The Store may provide access to third-party services, tools, or websites.

These services are provided “as is” and “as available.”
We are not responsible for:

  3. transactions,
  4. security practices,
  5. policies,
  6. damages arising from third-party interactions.

SECTION 12 — SHOPIFY PLATFORM DISCLAIMER

The Store operates using Shopify’s e-commerce platform.

Purchases made through the Store are transactions between you and Maddy Makers — not Shopify.

Shopify is not responsible for:

  2. fulfillment,
  3. warranties,
  4. shipping,
  5. returns,
  6. customer disputes.

You agree to release Shopify and its affiliates from claims relating to your purchases.

SECTION 13 — DISCLAIMER OF WARRANTIES

The Store and all products and services are provided:

to the fullest extent permitted by law.

We do not guarantee:

  1. uninterrupted Store access,
  2. error-free operation,
  3. complete accuracy of content,

  5. specific delivery dates.

To the fullest extent permitted by law, we disclaim all warranties, express or implied.

SECTION 14 — LIMITATION OF LIABILITY

To the maximum extent permitted by law, Maddy Makers shall not be liable for:

  3. consequential damages,
  4. loss of profits,
  5. loss of revenue,
  6. loss of data,
  7. shipping delays,
  8. customs delays,
  9. product misuse,
  10. dissatisfaction with products.

Our maximum liability shall not exceed the amount paid for the product giving rise to the claim.

SECTION 15 — INDEMNIFICATION

You agree to indemnify and hold harmless:

  1. Maddy Makers,
  2. Shopify,
  3. affiliates,
  4. employees,
  5. partners,
  6. suppliers

from any claims, damages, liabilities, costs, or expenses arising from:

  1. your misuse of the Store,
  2. violation of these Terms,
  3. infringement of third-party rights.

SECTION 16 — PRIVACY

Your use of the Store is also governed by our Privacy Policy.

By using the Store, you consent to the collection and processing of information described in the Privacy Policy.

SECTION 17 — TERMINATION

We may suspend or terminate access to the Store at any time without prior notice if:

Termination does not affect obligations incurred before termination.

Any disputes arising under these Terms shall be subject to the jurisdiction of the courts located in India.

Continued use of the Store constitutes acceptance of revised Terms.
